Environmental Groups to Sue EFH for 38,000 violations of the Clean Air Act

According to Burnt Orange Report, 3 environmental groups have put Luminant on notice that the groups will sue the company for 38,000 alleged violations of the Clean Air Act.  Luminant has delayed cleaning up three of its coal plants since its buyout in 2007.  This pollution harms people's health contributing thousands of premature deaths, heart attacks, asthma and other serious illness through its emission of particulate matter.  According to Luminant's own filings with the Texas Commission of Environmental Quality, the Big Brown, Monticello, and Martin Lake coal plants:

  • Are the top three industrial polluters in texas among nearly 2,000 industrial plants;
  • Spew more than 25% of the state's industrial air pollution;
  • Are 46% of the state's coal plant pollution;
  • emit 4,000 pounds/year of murcury;
  • emit 185,000 tons/year of asthma causing sulfur dioxide; and
  • emit 33,000 tons/year of smog-forming nitrogen oxides
